Rewards Program Terms and Conditions
Membership

The Hunter Street Hospitality Rewards Program (Hunter Street Rewards or Rewards Program) is a loyalty program operated by Pacific Hunter Group Pty Ltd trading as Hunter Street Hospitality (Hunter Street Hospitality, we, us or our) in accordance with these terms and conditions (Terms).

By participating in the Rewards Program, you acknowledge that you have read and agree to be bound by these Terms.

1. Definitions

(a) Account means the account created by a Member to access and participate in the Rewards Program.

(b) Birthday Dining Credit means a Dining Credit issued to a Member during their Birthday Month that can be applied as a discount toward eligible dine-in food purchases at Participating Restaurants during their Birthday Month in accordance with these Terms.

(c) Birthday Month means the calendar month corresponding to the Member’s date of birth associated with the Member’s Account.

(d) Dining Credit means a promotional credit issued to a Member that can be applied toward eligible dine-in food purchases at participating Restaurants in accordance with these Terms.

(e) Member or you means a person who has created an Account and is a member of the Rewards Program.

(f) Member Benefit means Dining Credit, Birthday Dining Credit and other membership benefits available from time to time as set out at hunterstreethospitality.com.au/rewards

(g) Restaurant means any Australian bar or restaurant operated by Hunter Street Hospitality from time to time, as set out on our website hunterstreethospitality.com.au/venues/

(h) Venue means a specific location operated by a Restaurant.

2. Participation in the Rewards Program

Participation in the Rewards Program is free. To be eligible to participate, you must:

• be aged 18 years or over;
• be a resident of Australia; and
• have the legal capacity to accept these Terms.

The Rewards Program is for personal use only. Each Member is limited to one Account. An email address and mobile phone number may only be associated with a single Account. Hunter Street Hospitality Group reserves the right to suspend or cancel any duplicate Accounts.

You may participate in the Rewards Program by creating an Account at hunterstreethospitality.com.au/rewards. To create an Account, you must agree to these Terms and provide your first and last name, valid email address, mobile number and birth date. If you do not provide the information requested in the registration process, you will not be able to participate in the Rewards Program.

We may ask you to provide additional optional information from time to time. This information may be used to personalise and tailor offers, communications, and member benefits for you.

You consent to receiving communications about the Rewards Program from us, including by email and SMS as set out in section 3 below.

To access your Account, you will need to login using your email or mobile number. No password is required, as you will receive a one-time pin code to login.

Once you have created your Account, you will receive an email with a link to add your digital membership card to Apple Wallet or Google Wallet. Alternatively, you can log into your account at any time and download the card via an online link. The membership card is not a credit or charge card and is not transferable. Any membership card issued to you remains the property of Hunter Street Hospitality Group. You are responsible for keeping your membership card and Account secure and for all activity associated with your Account.

3. Marketing Communications

By participating in the Rewards Program, you consent to receiving communications about the Rewards Program from us, including by email and SMS, so that we, or our partners, agents and contractors, can provide you with information about:

  • Hunter Street Hospitality and our Restaurants;
  • the Rewards Program, Member Benefits and your Account; and
  • any other information or offers that we believe may be relevant or of interest to you.

If you do not wish to receive marketing communications, you may opt-out at any time via the unsubscribe mechanism in our communications. Please note that if you opt out of receiving marketing communications, some Member Benefits may no longer be available to you.

We may still send you administrative and service communications about the Rewards Program from time to time, even if you have opted out of marketing communications. For example, we may send you communications about changes to these Terms or information about available or expiring rewards, such as Dining Credits including your Birthday Dining Credit.

In addition to the purposes outlined above, we may use and disclose your personal information for marketing purposes as set out in our Privacy Policy.

4. Your responsibilities

You are responsible for:

  • ensuring that all information you provide to us (including as part of the registration process) is accurate and complete and updating your Account online if any of your details change;
  • not transferring your Account to any other person or allowing any other person to use your Account or Member Benefits, unless expressly permitted by these Terms; and
  • not using Member Benefits in any unauthorised or illegal manner.

We may:

  • refuse your participation in the Rewards Program;
  • suspend, withdraw or cancel your Account; and/or
  • cancel any accrued Member Benefits,at any time where we reasonably believe that you:
    • are abusing or attempting to abuse the Rewards Program;
    • have materially breached these Terms or the terms and conditions of any Reward Program offers or Member Benefits; or
    • have engaged in conduct relating to the Rewards Program that involves theft, fraud, misconduct, abusive, offensive or inappropriate behaviour, or the supply of false or misleading information.
5. Leaving the Rewards Program

You can choose to leave the Rewards Program at any time by emailing us at rewards@hunter-street.com.au.

If you leave the Rewards Program, you will not be eligible to receive any future Member Benefits and will no longer be entitled to use any unused Member Benefits (such as any accrued Dining Credits, including Birthday Dining Credits) from the date your membership ends. Please consider this carefully before cancelling your membership.

6. Changes to, or termination of, the Rewards Program

We reserve the right to amend these Terms at any time. We will provide you with reasonable notice of any amendments to these Terms. Your continued participation in the Rewards Program after the notice period will be deemed consent to the amended Terms.

For the avoidance of doubt, Member Benefits are subject to availability and may vary from time to time at our sole and absolute discretion. Each Member Benefit is governed by its own applicable terms and conditions. Accordingly, the notice period set out in these Terms does not apply to any changes to Member Benefits. You should visit hunterstreethospitality.com.au/rewards to view the Member Benefits currently available and their applicable terms and conditions. In the event of any consistency between these Terms and the applicable Member Benefit terms and conditions, the applicable Member Benefit terms and conditions will prevail.

We reserve the right to suspend or terminate the Rewards Program at any time and for any reason. We will provide you with reasonable notice of any suspension or termination, during which time you may redeem any accrued Dining Credits (including Birthday Dining Credits).

7. Member Benefits

As a Member of our Rewards Program, you may be eligible to receive a range of benefits, which may include Dining Credits, exclusive menus, priority access to events and other offers as available from time to time. Member Benefits are subject to change and availability and may vary between Restaurants and Venues. Each Member Benefit is also governed by its own applicable terms and conditions.

8. Your privacy is important to us

These Terms should be read in conjunction with our Privacy Policy

By participating in the Rewards Program, you consent to us collecting, holding, using and disclosing your personal information as described in the Privacy Policy.

9. Liability

Nothing in these Terms limits, excludes or modifies (or purports to limit, exclude or modify) any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Terms would contravene any statute or cause any part of these Terms to be void (Non-Excludable Guarantees).

Subject to any Non-Excludable Guarantees, Hunter Street Hospitality Group excludes from these Terms all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non-Excludable Guarantee, Hunter Street Hospitality Group (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Rewards Program, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under Hunter Street Hospitality Group’s control); (b) any theft, unauthorised access or third party interference; (c) any registration or Member Benefit that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Hunter Street Hospitality Group) due to any reason beyond the reasonable control of Hunter Street Hospitality Group; (d) any variation in Member Benefit value to that stated in these Terms; (e) any tax implications; (f) the availability, use or expiration of a Member Benefit; and/or (g) any termination of a Member’s Account or cancellation of the Rewards Program, or any change to these Terms.

10. General

These Terms are governed by and are to be construed in accordance with the laws of New South Wales (NSW), Australia.

If a provision of these Terms is illegal or unenforceable in any relevant jurisdiction, it may be severed for the purposes of that jurisdiction without affecting the enforceability of the other provisions of these Terms.
